MINUTES OF THE BOARD OF DIRECTORS MEETING
OF BRISTOL LAKES HOMEOWNERS ASSOCIATION, INC.
HELD ON MONDAY, SEPTEMBER 22, 2008 AT 7:00 P. M.
AT THE WEST BOYNTON RECREATION PARK.

A meeting of the Board of Directors of Bristol Lakes Homeowners Association, Inc. was held on Monday, September 22, 2008 at 7:00 pm at the West Boynton Community Recreation Park.  The Meeting was duly posted.

Present from the Board were Charles Koch, President; Lew Doctor, Vice President; Treasurer; Mary Curlew, Secretary and Edward Tinari, Director. Brian Evans, Treasurer was out with prior notice.  Also present from Residential Management Concepts was Shannon Koorse and Anne Reyes.

Charles Koch called the meeting to order at 7:10 P. M.

Prior to the beginning of the meeting, Charles Koch introduced Ron D’Anna, the Association’s attorney, to explain the status of the Mandatory Membership case.  A letter to the residents as well as a copy of the Judgement from the Courts is attached to these minutes.  Charles Koch thanked everyone for being at the meeting.  He also stated that no personal questions would be answered in regards to the Judgement. 

Mr. D’Anna gave a brief history of his association with Bristol Lakes and how the Board asked him if there would be a chance to challenge the decisions of Mandatory Membership.

He discussed the documents and that they state there may be a Golf Club option but not mandatory but through the years it became mandatory.  Mr. D’Anna continued to discuss the various amendments that were brought up and that some were challenged.  The Judge looked at the law and looked at the issues and a motion from the Defendant for a Summary Judgement was denied and the Plaintiff’s motion for Summary Judgement was granted.

Mr. D’Anna stated that this judgment would be appealed.  He also advised residents that he is the representative of the corporate entity and cannot represent individual issues.  He stated that all individuals should get a copy of the judgment and discuss it with their own attorney or real estate.  He noted that the judgment states that the plan and scheme of the development was changed.

Mr. D’Anna explained the appeal process and he also stated that the association is still in a battle but in a good place.  The Case would not be completed until there is a final hearing and at that time it would be closed.

Charlie Koch read a note to homeowners, which were sent by email together with the Judgement.  (attached)  Charles Koch made a few comments about the process of the case and the help of the residents during the past year to help proceed with the case.

Residents thanked the Board for all their work on the Mandatory Membership case.

Residents inquired about the Line of Credit, which is now a loan and how much was left on it.  Lew Doctor stated that there was $53,000.00 left to pay off.                     

PROPERTY MANAGER’S REPORT

Shannon Koorse reported that the vine trimming on the ficus hedges would begin on Wednesday.  She stated that there had been some complaints about the trimming and landscaping in the Community.  She has contacted Tazz and they have taken care of the problems.

Shannon Koorse also stated that there had been some problems with the sprinkler heads and the clock was broken.  These issues have been taken care of and Z-Team continues to work on it.

Charlie Koch added that the vine trimming on the ficus is being done to keep the ficus hedge from dying.

OLD BUSINESS – NONE

NEW BUSINESS

A resident stated that the Royal Palms were fertilized but they missed thirteen (13) Palms.  Shannon Koorse would call Mignano’s to see when they will come out to complete the job.

Mary Curlew asked if everyone received their letter from Comcast in regards to picking up their boxes on October 21 from 10:00 AM to 4:00 PM.  Make up day for pick up of the boxes would be November 13, 2008 from 2:00 to 4:00 PM.  If the resident cannot make these days they can go to the Comcast office at 1595 SW 4th Avenue, Delray Beach or call 561-266-2278.

Charlie Koch suggests that they bring their old boxes with them when the new boxes are picked up.

A resident asked about the front entrance landscaping.  The Board replied that at this time there is no one taking proper care of the area.  A small trimming was done recently but as there is a recurrent problem with the landscapers that they fail to keep it up.

Charlie Koch stated that the mailboxes and any other project are on hold.  If the case goes on for too long the Board would look at the other projects to determine what can be done and when.

There being no further business before the Board, Mary Curlew moved to adjourn the meeting; seconded by Charlie Koch.  All in favor.  Motion carried.

The meeting was adjourned at 8:15 P. M.
