MINUTES OF THE BOARD OF DIRECTORS MEETING OF BRISTOL LAKES HOMEOWNERS ASSOCIATION, INC. HELD ON THURSDAY, JUNE 28, 2007, AT TEMPLE SHAAREI SHALOM AT 7:00 P. M.
Minutes of the Board of Directors meeting held on Thursday, June 28, 2007, at 7:00 P. M. at Temple Shaarei Shalom.
The meeting was duly posted.
Those members present were Lew Doctor, Vice President; Brian Evans, Treasurer. Charles Koch, President and Ed Tinari and Mary Curlew, Secretary. Also present were Bruce Budwig and Anne Reyes from Residential Management Concepts, Inc.
Charles Koch called the meeting to order at 7:00 P. M.
MINUTES
Lew Doctor moved to waive the reading of the minutes and to approve the minutes of the May 24, 2007 meeting as presented; seconded by Mary Curlew. All in favor. Motion carried.
FINANCIALS
Brian Evans stated that as of June 28, 2007, the Cash operating account balance was $146,442.08 and in the cash replacement account the balance was $94,824.41, which as of June 28, 2007, the Unaudited total is $241,266.49. Brian Evans also stated that there were delinquent accounts in the amount of $19,194.06, which represents 14 homes. He also stated that approximately $16,500.00 was over four months representing six homeowners.
A discussion ensued in regards to the State changes that will go into effect after July 1, 2007 whereas an Association can charge 18% interest per annum on late accounts.
Lew Doctor asked if there were any changes in the foreclosures in process, such as the home on Lot 001, as there are new people in the home.
Lew Doctor stated that no bar codes or cards could be given to the residents unless there is proof of title to the property.
The Board is concerned that someone has moved in without notice.
PRESIDENT’S REPORT
Charles Koch stated that he had a conversation with the Attorney’s office in regards to locking out the residents of the community. It was stated that if there is a Guard then you can but without one, they can go in.
When Charles Koch returns he will schedule a meeting with the Attorney’s office to go over the deposition minutes.
In regards to the problem with the plastic trash bags, Bruce Budwig stated that as the documents state plastic bags and trashcans can be used, neither the County nor Code Enforcement would come out to site the homeowners.
Bruce Budwig also stated that the lights were replaced on the guardhouse and are on a timer.
Charles Koch asked if the guardhouse had been cleaned. Bruce Budwig replied that someone should clean out the dead ants and straighten out the guardhouse.
Charles Koch stated that he would inquire with his cleaning people to see if they could do the work.
COMMITTEE REPORTS
Lew Doctor stated that he had a quote from Bugaway for tree trimming inside the Community in the amount of $28,000.00 and another quote from Mignano for $14,000.00. There were about 478 trees. Lew Doctor also stated that not every tree needs trimming. Lew Doctor will discuss with the Board to see if Dave Teller could oversee the process.
The Board will proceed with the tree trimmings.
In regards to the Littorals, the POA is responsible for the upkeep and it needs to have 80% coverage with plants. The POA is putting $4,200.00 towards plants and Campbell Management would do the planting. Dave Teller and the Property Management Company of the POA are monitoring this project.
One resident stated that new plants were planted and the next day someone came and sprayed them. It was also stated that some plants are floating due to them being planted improperly. They need to be netted and have rocks to hold them down.
Lew Doctor stated that the POA has two contracts for the Reclaimed Water Project, Lake Worth Water and Palm Beach County. As a result of this project and the installation, new plantings on Hagen Ranch Road will be postponed.
Charles Koch stated that Lisa Teets from Campbell Management was going to do a walk through but based on previous promises and that she has never come for the walk through, he will forward his concerns to the Association’s Attorney in order to send a letter.
OLD BUSINESS
It was stated that when the Association has another mailing, there must be a reference once again, in regards to dog cleanup in the community.
Charles Koch stated that a dump truck was in front of the community and that he got the number and called them so that they could move it. It hasn’t returned as yet, it is not to be allowed on property.
Charles Koch requested that the residents advise the Board if they see any strange cars parked on the property or to report to the Management Company.
A resident asked if the money owed to the Association is from an original owner. He was advised that some go back to last year.
Lew Doctor stated that two homes were abandoned and were in foreclosure. The Board follows the legal procedures with the Attorneys.
The Board attempts to call and collect the fees from the owners.
Bruce Budwig stated that the Board needs clarification to see if interest can be charged on old amounts prior to the July 1st law changes. He will check with the Attorneys.
NEW BUSINESS
Lew Doctor stated that the POA is looking into a Solar Energy project to reduce electric expenses, as they are responsible for the irrigation pumps etc. The cost of the project is about one million dollars and a certain percentage will be covered by grants.
Lew Doctor reported that the clear Lexan bolted on windows has been approved as a window treatment and won’t have to be followed by the rules of shutters. He also stated that there have been some changes on the ARB’s in regards to shutters and permanent generators. He will put them on the Website as well as reminding the community that if there are any changes in ownership the Management of Aberdeen must be notified.
A discussion in regards to ARB approvals ensued. If some one is painting a home the same color, no approval is required. If a resident changes colors, a form must be submitted to the ARB Committee as well as a sample of the new colors.
Some owners stated that they want to change the colors of their doors. A door must maintain the color profile of the house.
Lew Doctor stated that the rules and regulations should have something about changing the color of the doors added. The discussion continued about colors for houses and some limitations should be applied in order to avoid blues and other colors. It was stated that the earth tone colors should be kept.
Lew Doctor asked if the Board should limit the color ranges of homes, roofs and doors.
Charles Koch stated that he would like a range of earth colors for the next meeting in August and also added that until the August meeting any requests to change the door colors should be held until colors are chosen.
The Board will set up the guidelines and give them to the Architectural Review Committee in regards to doors, roofs, trim and house body paints.
The Board and the residents discussed the types of damage that could be caused by a hurricane and the things that can be done to help prevent some damages.
Charles Koch would like John Curlew to be appointed to the legal committee.
Lew Doctor moved to approve John Curlew as a representative on the legal committee; seconded by Brian Evans. All in favor. Motion carried.
There being no further business before the Board. Lew Doctor moved to adjourn the meeting; seconded by Ed Tinari. All in favor. Motion Carried.
The meeting was adjourned at 8:05 P. M.
