2002 Ad Hoc Meeting Minutes

January Ad Hoc Minutes

Opening Remarks

POA has approved a new contract with Adelphia extending it 5 years 1/1/2004 -12/31/2008. HBO 1,2 and 3 are included in the service and should be available 120 days after contract signing. No additional cable box is needed but your TV does have to be able to receive the signals (connected to a CATV outlet). CATV inputs have been on TVs for probably more than 7 years. There is actually no additional cost and it is included in our POA monthly dues.

Treasurer Statement -

Because of an operation, Pat was not able to attend this meeting. The report we received was that we have had a very good response to the letter informing people that they owed dues for 2001. As we thought, many owners just didn't know they had not paid for 2001. The emails and letters for 2002 dues will be going out by February 1, 2002. Any new homeowner (Oct. Nov., or Dec. close) who paid 2001 dues does not owe for 2002 and will not get a letter.

Next Quarterly meeting -
February 21, 2002 will be at the Aberdeen Club House. Because of new costs (charge per person attending), the coffee would run about $100 so we will not be providing coffee at the meeting. Please feel free to bring your own refreshments.

What's the magic number of homes for takeover?
As of January 10, 2002, it looks like we have 123 homes closed and 19 lots under construction. The magic number is 148 closed homes.

Update on Common Area by East Lake

The area was seeded by M/I Homes which is all that they plan on doing. The Common Grounds Committee will continue working on what type of landscaping can be put in the area. A first rough draft was reviewed by all homeowners around the area but needs to be expanded.

Report on Lights:

* We are continuing to work on the lighting issue. We will be showing a proposed plan at the February meeting.
* We are working with FPL to determine costs and what can be done to improve our community lighting. Again this month, because of the lack of good lighting we are asking anyone walking in the community at night to wear reflective clothing.


Committee Status

We did not get updates from the committees because of the short time between monthly meetings.


M/I Homes Letter Discussion

Letter will be sent first part of February. We reviewed it with one of the lawyers we are interviewing for takeover.


Legal issues


Budget increase discussion - It looks like there is nothing that can be done about the 27% increase in our monthly dues. It is the HOA board's (M/I Homes) right to increase it. However, it will be recommended to the new board that all costs be looked at very closely.


New Business from December:


The following questions and issues were raised and will be researched for the February meeting.
1) Gate cards - What is the status on these and can we get new ones made? Initial research shows that they are no longer supported. Additional checking will be done.
2) Keys for guard gates - More data needs to be gotten
3) How many houses not closed? 42
4) Kid's using wood ramps in streets? This will be raised at the February meeting
5) East Lake Common area not a park - discussion at February meeting.


New Business:
1) We interviewed our second law firm for turnover, Jay Levine Attorneys. Because of the short time to turnover, we need to increase the review of Lawyers, accountants, and engineering firms for turnover. We will start meeting 2 times a month to review firms. The Ad Hoc Meeting will continue to be on the third Thursday each month.
2) We just learned that several of our new home owners have not been welcomed to the community in a timely manor. If you have been here for the last couple of months and not had a visit from our Welcoming Committee, they will be there soon. The Welcoming Committee provides new owners with a wealth of information a home owners manual. We are sorry that it took so long to welcome you.

Open Floor for new business Tom chaired discussion:

New Issues discussed
1. Corner without side walk & handi-cap ramp - Committee will see what can be done
2. Poop is still a problem - Committee will monitor and send out another letter if needed
3. List of common rules - It was suggested that we post the common rules for all homeowners. There is an increasing amount of rules being broken - probably just new owners not having time to read the rules. Committee will develop a list.
4. Landscape around equipment: A/C, Pool pumps - All homeowners must have landscaping or a small fence around equipment including Garbage cans if they are outside. Equipment cannot be seen from the road.
5. Kid's making trouble - late at night and at a party - The homeowners who's children were involved were at the meeting and sent a formal letter to the committee and community stating that the children were spoken to and it will not happen again. They wanted to let the community know that they have addressed the issue. Anyone who would like to see the letter should contact Tom.
6. Homeowner Complaints - Complaints still need to go directly to CAS- They should not be coming to the Ad Hoc Committee,
7. Security camera - Committee has looked into getting Security cameras for the front gates and because of cost, will forward the study to the new board when elected.
8. Code system - Issue has been raised about the card entry system being shut off - Committee will talk to M/I about keeping it.
9. Guard - Some ask about getting one. - The cost will be high and it will be tabled until the new board is elected.
10. Lakes: issues - Committee will look into the issues raised
11. Social picnic at new park - Follow up on the November meeting item about having a Block Party - Picnic for the community - Picnic committee found that the new Boynton park could be rented.
12. Painter for group homes - The time is near for some of the original homes to be painted, the subject of getting all the homeowner together to decrease costs was raised. Nothing decided at meeting, homeowners will look into it
13. Filter for sprinkler - Question was raised and issue needs to be addressed by the new board once elected Reason for filter is homes are being discolored by water
14. Sprinkler & chemicals and fertilization is staining sidewalks - Issue needs to be addressed by new board
15. Sprinkler on an individual system - Committee will look into if this can be done but at this time no homeowner should be bypassing the community system. M/I Homes is getting involved with the problems we are having and has promised to stay on top of the problem. After construction completed the constant problems we are seeing should go away.
16. Road & walkway damages - Addressed in M/I Letter
17. March Ad Hoc Minutes

Meeting opened at 7:00 PM. Attending members: Joey, Howard, Bruce and Treasurer Pat Giombetti


1. Picnic: All AD Hoc members would like to see flyers before they are passed to the community.
2. Picnic - some home owners complaining about Bristol Lakes AD Hoc paying for park. It was noted that this community event was approved by the members at the November quarterly meeting and that paying for the park is not any different than renting the Country Club for a meeting. Pat will ensure that any funds left after paying for the food from the homeowners participation fees will be used to offset the park rental. Picnic: Everyone should be welcome - whether dues are paid or not.
3. Because Tom could not attend, he sent a note to the committee detailing the response from M/I Homes to the February letter. The members discussed Tom's notes from meeting with Mark Welch (see note below)
4. Dave Teller has information lakes, chemicals, and sprinkler. Need to formally invite him to next meeting so that we may all hear what he has to say.
5. Howard informed us about POA approving pipe for lake connection.
6. Sidewalk and street damage. Need to delicate people to get an estimate for this issue.

Tom's Letter to Ad Hoc Committee


Bristol Lakes Ad Hoc Committee



Between flights and at the last moment, I was able to get a meeting with Mark Welch to discuss the issues in the letter we sent him. The community is sold out and they will probably be taking down the Model Flags soon. The people who own the BV model will move into to it in July, M/I still has the rent on the KL until end of year. However, they are still 5 months from getting to the point where they will start on their new community south on Hagen Ranch. He did not think they would be using the homes as models for that community because of timing.

We also discussed when M/I believes they will hit 90% closed and start turnover. Mark believes it will be August or September. I thought June or July. So, he agreed to put together a report for us showing their building schedules and projected closings. This will allow us to track the activity and have a smooth turnover. Below are his comments and commitments on the letter:


1. Because of the large 27% increase in the monthly dues, we need to update the community on the increased cost of services. The justifications in the letter were not clear or detailed enough to most of the homeowners. They need to understand where our money is really going. To do this, the Ad Hoc Committee would like to get copies of the 2000 and 2001 P&L statements along with a statement of what, if any, reserve accounts exist.
Response: Mark will have his office send us the P&L statements so we can review the spending. I also questioned the reserve funds and if they would be available at turnover. Mark did not know the answer but stated that we would see the information on the reserves in the P&Ls.

2. The front gate has been a security problem for quite some time. Several of the homeowners were told during the sales process that there would be a secure fence and not just bushes closing in the Bristol Lakes entrance way. The question we keep getting is when will the fence be completed between the pedestrian gates and the perimeter wall? At the present time our nighttime security is zero. Pedestrian traffic intent on theft or malicious vandalism has gained access far too easily. In the last couple of months, we have had a car broken into and another one stolen. In September two large stray dogs casually came in, found a stray rabbit and chased it into a homeowner's downspout. They then tore the piece of aluminum off the house and chewed gapping holes in the metal. We do not know what would have happen if they had found a person instead of a rabbit. We think the fencing is an issue M/I Homes should address. We would like to know M/I Homes' position on putting in the fencing.

Response: Mark will look into putting up an iron fence from the end of the gates to the walls back by the hedges that currently exist. This should solve people entering the community without jumping a fence.

3. Security is always uppermost on people's minds and Bristol Lakes seems to be woefully lacking. The main and pedestrian gates need additional security such as a card reader or key locks to prevent unwanted people from stealing our valuables and your construction supplies. We have been informed that M/I Homes plans to stop using the card system installed currently because it no longer works or you cannot get cards. Many of the homeowners, including myself, have been asking for access to the card system for years and some homeowners have been given cards while others have been told they could not have a card. However, the construction crews do not seem to have any problem getting access. The association must have a card entry system that works and allows all the homeowners to get cards. We believe this is a builder issue and would like to know M/I Homes' position.

Response: They are no longer looking at deactivating the card reader. Mark actually has a box full of cards that they thing work, (he just grabbed one at random and it works fine). We would need to test that all work but M/I will provide us with at least 1 card per lot and the information we need to have additional cards made if needed.

Construction crews do not use cards; they have door openers that they use to gain access. The new board will need to monitor that no crews keep door openers after construction has been completed.

There are currently no locks on the pedestrian entrance gates on the front fences that exist. The new board will need to figure out a way to guard entrance through these gates. The current gate latches have lock holes and we could put locks on the gates with a common number to allow homeowners to use them but that is something that M/I will not address.

4. The current perimeter wall in many places is not high enough to keep people from easily jumping over. Back in the early 1990s when it was first built the fence may have been the required 6 feet high. However, the landscaping you have added over the years to the property to help sell homes has made the wall much less secure. Again, this is an issue that we think is the builder's responsibility. We would like to request that hedging or some other type of barrier be added to the wall to increase its height 2 or more feet.

Response: This one Mark stated he would look into what could be done but there is no county ruling that would justify them needing to do anything. It sounds like the new zoning doesn't even require a fence be put in anymore. I do not believe M/I will be stepping up to add any additional walling. This one will need to wait until the board is official.

5. Because of all the heavy construction traffic over the years, our streets are currently in need of repair. We would like to suggest that a month after the final 5 houses are started and heavy trucks are no longer needed for construction that our streets be stripped and a new surface coat of pavement applied. This should repair the damage from all your heavy construction trucks. We would like to know M/I Homes' position on this idea.

Response: M/I will put together the cost of putting down a sealing coat on the roads to make them look like brand new. This would cover all cuts, breaks, and holes if any that exist. Mark stated is what M/I does is make available to the board the money to do the topping and they have the choice to do it or not. He also stated that he has not seen a community actually do the improvement yet, they usually use the money for other things. It does not sound like the process will actual strip away a layer of several inches but then our streets probably do not need that level of repair.

6. Cleaning the storm sewers is also an ongoing problem as long as there is construction. Once outside construction is completed, we would like to have M/I Homes make sure the storm sewers are cleaned one final time.

Response: M/I will hire a firm to come in and completely clean out all the sewers once the construction is completed. They want to wait until all construction is complete so there is not potential for problems after the cleaning.

7. The entry sign lights are too high and block the sign's lettering. We would like to have lights lowered so the community's name can be seen.

Response: Mark is already working on the problem and contracted an company to check into lowering the lights; they also cleaned out the junk flowers by the sign.

8. The sprinkler system is always breaking down or has some type of problem. There have also been several statements made by multiple owners that they do not believe the system can support 165 lots. Can you submit proof that the system will support 165 homes so we can update the owners at our next meeting? We would also like to get a copy of the as built plans for the system.

Response: Mark has been assured by South Eastern that the system is actually a very good system and once they get by the construction, our problems should not exist. The problems have been with pipes getting cut sometimes several times a week. M/I will send us a letter stating that if we want. I think it would be a good idea so that we have their commitment that the system is good. One of the additional costs relating to #1 is monthly they are having South Eastern test and map the sprinkler systems. I guess this week they had 3 breaks in the system, one west and 2 east.

M/I is actually handling all problem calls directly with South Eastern from this point forward. Homeowners still call CAS, but CAS calls Mark's staff and they are tracking the work directly with South Eastern. South Eastern is conducting tests monthly now to make sure all the systems are working and heads are clean and working. I suggested that they make sure that the timers are also working correctly. Several times the home system is fine but never gets turned on from the timer. M/I will get us a copy of the complete built plans (how the system is put together) so we have the information.

9. We would like to get the current plans for the common area near the east lake.

April Ad Hoc Meeting

The Next General Meeting will be May 23, 2002. Because of costs, the meeting will be held in a room at the Boynton Park (same place as the picnic).
Turnover costs will be presented at the meeting.
Will probably be the last general meeting before the turnover meeting.

Picnic will be April 27 - The Ad Hoc Members are helping as much as possible. Tom on Food detail and Clean-up, Joey on Baseball and activities, Howard on clean-up.

* Will schedule evening next week for an engineer and an Accountant interview.

* We will create TO DO LIST for new Board (BTDL) and a TO DO LIST for Ad Hoc turnover (ATDL). These lists will be put on the web private page by May meeting.
Treasurer's report: Must owners have paid their 2002 - thanks to Pat's for all her hard work. We have $4170 in the account



New Business:


* Tom will build a letter in response to a letter from CAS to MI/HOMES about our watering situation.

* We have gotten Security Cards (2 each) for all Homeowners. Pre-MI/Homes owners already have cards and we need to inventory those. We need to activate the new cards and will start passing them out at the May general meeting. A letter will go out to all owners to get the numbers on any cards that have already been passed out. For security reasons, we will deactivate any cards that have not been inventoried.

* Debra Appel has agreed to chair the Security Committee. Thanks Debra.

* It was noted that using the Fire Hydrants to water lawns is illegal and any owner using one should be reported to the authorities. Adding to FAQ on Web

* Dave Teller did an excellent study of the current state of our lawns and trees. He gave the Ad Hoc Committee a report, which will be reviewed to determine what if any actions can be taken.

* The east common area has finally been sod. We surveyed all the owners that live around the area and concluded that all were promised landscaping which is more than just sod. We will raise the question with M/I and add getting landscaping to the BTDL.

* Question about owners fishing came up and owners are allowed to fish. Adding to FAQ on web.

* Question on changing any rule in the Homeowners Docs has come up. To change any rule a petition must be drafted and after a review by the board, a vote by the majority of the owners is required to pass any new rules. Adding to FAQ on Web.

* Sprinkler systems ? We all know the problems that have been going on for the last 3 months. We have requested the built plans from M/I and will have as part of the Engineering report for turnover a detailed analysis done. Action moved to BTDL.

* Light poles are becoming in bad repair and need to be painted. Moved to ATDL. Also if light goes out, you call FPL and give them your address or the pole number, they will come out and change the bulb.

* In reference to safety issues with people walking or riding, Home Depot has a safety strobe (battery operated). It is a little longer than a dollar bill and can be attached to your belt, bike or dog. Please think about getting one so everyone is more visible at night.

* Many owners are not following the 5PM rule about putting out your garbage cans. We will be going though the entire general rules at the next meeting.

* It was noted that a few homes have renters. A renter is under the same rules as any homeowner.

17. Issue came from two of owners about using funds for picnic rental fee. Owners have been answered. Board concluded the expense was justified because it was an approved (by vote at November meeting) community event. Issue closed.

We had approximately 60 people at the meeting. Note: It would have been impossible to have this meeting in the old Country Club meeting room. The new facility is excellent, cheaper, and bigger and will be used for all future association meetings.

Irrigation Problems

* Problems existed between CAS, MI Homes, and Southeastern during January - March
* April fixes started to be completed
* They have a good plan and are executing it. Most Major problems are fixed
* Once Major Problems were fixed, minor problems started surfacing with homeowners
- Some Homeowners were turning on valve
- CAS has sent letter to 6 homeowners who have continued to turn the valves back on after Southeastern turns them off.

Joey presented our community's rules. These rules need to be obeyed!

* One homeowner received CAS letter about valves but has not touched them,

Tom adjourned the meeting at 8:30 and invited everyone to come up to get security cards.

Distributed Security Cards


* There were 122 cards issued by our builders and we must determine who has these cards. If you were issued cards by either of our builders, you must call Sherry Houy and register your card number(s). On the day after takeover, all cards that have not been registered will be deactivated.
* We should have enough for at least 2 cards per home.
* We have had many requests for additional cards, we are looking into purchasing more cards but do not have an answer yet.
* For people not able to attend the meeting, they should call Sherry Houy to schedule a time to be issued their cards.

Bristol Lakes Homeowners Association general and board meetings proposed Code of Conduct

In order to further a productive flow of information and to create a professional atmosphere that will encourage all homeowners to participate in the affairs of our community we should all follow the following rules.

* When meeting are called to order, all electronic communication devices will be silenced.
* There will be no private conversation during the meeting.
* All speakers will be recognized by the meeting Chair and no homeowner will speak while another homeowner has the floor.
* Homeowners should make every effort to keep comments clear and concise.
* Discussions shall be conducted in a professional manner. Profane, inflammatory, or disrespectful language, gesture or demeanor will not be tolerated.

Recognizing that we serve as volunteers with the common purpose of furthering the community, we resolve to work in a civil and courteous manner toward that goal.

Community Rules


* Homeowners are responsible for maintaining their property in a first class condition (5.2)

* No signs may be placed on the homeowners lot, nor in or on the home where they are visible from the exterior. (6.22)

* Any improvement on the homeowners lot or exterior of the home is subject to obtaining written approval from the ARB. (6.3,6.5,6.9,6.11,6.15,6.18,6.19)

* Personal property must be kept inside the home or fenced. Items must not be visible from the street. (6.1,6.16.6.22,6.25)

* No swimming or boating is allowed in the lakes or canal. (6.8)

* Homeowners are not permitted to conduct business outside of their home or in a manner such that customers or patients come to the unit for non residential use. (6.12)

* Animals other than common household pets are not permitted. As regards cats and dogs, only two such pets are permitted except with the consent of the Association. Pit bull terriors are not permitted. Pets must be carried or be on a leash when outside of the home or fenced in area. Pets may not be kept outside of the home or in a screened or fenced in area unless someone is present in the home. Homeowners must pick up and remove any solid waste deposited by their pets. (6.17)

* Garages may not be permanently enclosed nor converted into living or storage space unless the garage maintains two automobiles. Garage doors should remain close when not in use. Only private passenger vehicles including pick up trucks up to 3/4 ton may be parked on the home owners property overnight. No overnight parking is allowed for commercial vehicles, trucks, recreational vehicle, camper, trailer or boat unless kept inside garage. No overnight parking is permitted on street , lawn, or areas other than the driveways and garages except with the consent of the association. (6.5, 6.24)

* All garbage containers and recycle bins must be kept inside the unit or screened from view and must not be placed outside no earlier than 5:00pm on the day before the scheduled date of collection. Trash facility must be removed on the collection day. Garbage must be placed in appropriate trash facilities or bags. (6.6 , 6.7)

* No homeowner shall make any improvement or modification to the sprinkler system which will affect the common sprinkler system. Homeowners in violation will be responsible for any cost relating to the irrigation system. (5.1.4)

Homeowner spot light

During the meeting several people were thanked for their hard work for our community. We think someone who deserves everyone¹s recognition & gratitude was accidentally overlooked. Judie Stramanak does a tremendous job welcoming new homeowners. This is a very important & time consuming service for our community. The Welcoming Committee could not manage without her! The Ad Hoc Committee is sorry for overlooking one of the most important people in our community. Thanks again Judy!

June Ad Hoc Meeing Minutes


Tom opened the meeting at 6:50.
Committee Attendees: Tom, Joey, Bruce and Howard.
Homeowners attending: Debra Appel and Rebecca Walker
At 7:00 we interview our last accounting firm for the turnover.
A vote was taken and it was unanimous for the firm of Feldman & Feldman. We have finished selecting the firms we need for the turnover.


* Our Attorney will be Gelfand & Arpe, P.A.
* Our Engineering Firm will be Omega Engineering Consulting
* Our Accounting Firm will be Feldman & Feldman

Next on the agenda was old business.


Old Business
* Light poles are becoming in bad repair and need to be painted. FPL had not been contacted yet to determine if they would paint them. Bruce will call this week. Also if a light goes out, you call FPL and give them your address or the pole number, they will come out and change the bulb.
* List of common rules ? It was suggested that we post the common rules for all homeowners. List is part of Welcome Package. We covered the rules at the May meeting? This item is Closed
* Landscape around equipment - A/C, Pool pumps- All homeowners must have landscaping or a small fence around equipment including Garbage cans if they are outside. Equipment cannot be seen from the road. Issue came up that many owners are putting up fences to hide pumps and air conditioners from the road per homeowner?s rules. These fences must be kept in good condition and not allowed to become an eyesore. The rules state that our homes must be kept in ?First Class? condition. Our rules cover the fences being kept in good condition.
* Painter for group homes ? Homes must be painted every 5 years and the time is near for some of the original homes to be painted. The subject of getting multiple homeowner together to try and decrease costs was raised. Not sure what has happen- Pat will drive? - Need to get the colors for the houses from M/I.

Web Update

* Just to remind everyone, the process for turnover is defined on the web site.

New Business


* Renter Issues: The subject has come up about renters being able to attend the Ad Hoc Committee meetings and receive minutes for our meeting. We could not find any reference to renters in the rules. We discussed the issue and voted the following. These recommendations will be submitted to the new board.

* Renters have no right to attend or get minutes. This is a Homeowners Association Ad Hoc Committee. They can, however, visit the web site to keep up to date if they wish.
* They can attend any community social event as long as they pay their share of the costs.
* An additional question was raised by the community about having a renters review and approval board. That is an issue for the new board. It should be noted however that our rules state that the community is a single family home community. This rule applies to renters as well. A homeowner can only rent their house to family. This would be a couple and children. One additional family member like a mother or father or sister, etc. would be acceptable but more than that would not.
